Privacy Policy

Volt Labs Inc. ("Volt," "we," "us," or "our") is committed to protecting the privacy of your information. This Privacy Policy describes how we collect, use, and share information when you visit our websites, including textvolt.com (the "Sites"), and when you use our messaging platform, account portal, APIs, and related services (the "Services"). It applies equally to any rebranded or white label version of the Services.

1. Information We Collect

Information you provide to us. When you create an account, request a demo or trial, fill out a form, or contact us, we collect information such as your name, organization, email address, telephone number, and account password. When you purchase Services, we or our payment processors collect billing information. When you communicate with our support team, we collect the contents of those communications.

Information collected automatically. When you visit our Sites or use the Services, we collect standard information from your web browser (such as browser type and language), your Internet Protocol (IP) address, device information, and the actions you take on the Sites (such as pages viewed and links clicked). We refer to this as "Navigational Information." We collect Navigational Information using cookies, web beacons, log files, and similar technologies, described in Section 4.

Platform usage information. When you use the Services, we collect information about your use of the platform, such as message volumes, delivery outcomes, campaign and registration details, and account activity. We use this to operate, bill, secure, and improve the Services and to meet carrier and regulatory compliance obligations.

Customer Contact Data. When you use the Services to communicate with your contacts, you provide us with information about those individuals, such as their phone numbers, names, and message content ("Customer Contact Data"). We process Customer Contact Data on your behalf and on your instructions, as described in Section 6.

We do not knowingly collect personal information directly from children under the age of 13.

2. How We Use Information

We use the information we collect to:

• Provide, operate, maintain, secure, and improve the Sites and Services;
• Set up and administer your account, process payments, and provide customer support;
• Respond to your requests. For example, if you fill out a "Contact Me" form, we will use the information provided to contact you about your interest in the Services;
• Send you transactional and operational communications about your account, billing, security, compliance, and the Services;
• Market and promote our Services to you, subject to your right to opt out of marketing communications at any time (Section 9);
• Comply with applicable laws, carrier requirements, industry registration requirements, and legal process; and
• Generate aggregated, anonymized, and de-identified analytics that do not identify you or your contacts, which we use to operate and improve our products.

We do not use Customer Contact Data for marketing, and we do not sell it or use it for any purpose other than providing the Services, as described in Section 6.

3. How We Share Information

We do not sell personal information, and we do not share personal information with third parties for their own promotional purposes.

We share information in these limited circumstances:

• Service providers. We share information with vendors who need it to perform work on our behalf, such as telecommunications carriers and aggregators who transmit your messages, cloud hosting providers who store data, payment processors, and analytics providers. These providers are permitted to use the information only to provide services to us.
• Legal requirements. We may disclose information if required by law, or if we reasonably believe disclosure is necessary to comply with a judicial proceeding, court order, or legal process, to enforce our agreements, to protect our rights or the safety of others, or to protect the public from harm.
• Corporate transactions. If Volt goes through a corporate sale, merger, reorganization, dissolution, financing, or similar event, information we have collected may be part of the assets transferred or shared in connection with due diligence. Any acquirer or successor may continue to use your information as set forth in this Privacy Policy.

4. Cookies and Tracking Technologies

Cookies. We use cookies to make your interactions with our Sites easy and meaningful. Session cookies exist only during one browser session and are required to use the Services, such as keeping you logged in to your account portal. Persistent cookies remain on your device after you close your browser and help us recognize returning visitors. We do not store account numbers or passwords in persistent cookies.

Third-party analytics and advertising cookies. We engage third parties to help us analyze how visitors use our Sites and to measure the performance of our advertising. These third parties may set their own cookies. This Privacy Policy does not cover third parties' use of their own cookies.

Web beacons. We may use web beacons alone or with cookies to understand usage of our Sites and interactions with emails we send, such as whether a link in an email was clicked.

Your choices. Most browsers let you block or delete cookies through browser settings, though blocking session cookies may prevent parts of the Services from working. Where required by applicable law, we honor browser-based opt-out preference signals, such as the Global Privacy Control, for the residents of states that recognize them. 5. Security

Volt maintains administrative, physical, and technical safeguards consistent with industry standards for SaaS providers of similar size and scope, designed to protect the information we hold from unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, however, and we cannot guarantee the security or integrity of data transmitted over the Internet or carrier networks. Please note that SMS messages are transmitted unencrypted over carrier networks.

6. Customer Contact Data and Our Role as a Service Provider

As part of the Services, Volt hosts and processes data, including personal information, about the individuals our customers communicate with through the platform. With respect to Customer Contact Data, Volt acts as a service provider (or processor) on behalf of its customers. When we process Customer Contact Data on your behalf, we will not:

• Retain, use, or disclose Customer Contact Data for any purpose other than performing the Services and following your instructions;
• Use Customer Contact Data for marketing or other commercial purposes;
• Sell Customer Contact Data or promote its sale; or
• Disclose Customer Contact Data to unauthorized parties or outside the direct business relationship between you and Volt.

We may access Customer Contact Data to provide the Services, to address technical or service problems, to comply with our customers' instructions, and to meet legal, security, and carrier compliance obligations.

If you received a message sent through Volt's platform, the sender is responsible for the content of that message and for how your contact information was obtained. To exercise privacy rights with respect to that information, contact the business that messaged you. If you contact us instead, we will refer your request to the relevant customer and support their response as required by law. 7. Data Retention

We retain personal information for as long as needed to provide the Services, comply with legal, tax, accounting, carrier, and compliance obligations, resolve disputes, and enforce our agreements. Messaging logs, consent records, and compliance records are retained in accordance with our internal retention policies and applicable legal requirements.

8. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights with respect to your personal information under applicable state privacy laws, including the California Consumer Privacy Act:

• The right to know what personal information we have collected about you and how we use and share it;
• The right to access and receive a copy of your personal information in a portable format;
• The right to correct inaccurate personal information;
• The right to delete personal information, subject to legal exceptions;
• The right to opt out of the sale of personal information or its sharing for targeted advertising (as noted above, Volt does not sell personal information or share it for cross-context behavioral advertising); and
• The right not to receive discriminatory treatment for exercising your rights.

To exercise any of these rights, email help@textvolt.com with the subject line "Privacy Request." We will verify your identity before acting on your request, and we will respond within the time required by applicable law. You may use an authorized agent to submit a request on your behalf, and if we decline a request, you may appeal by replying to our decision.

If your personal information was provided to us by a Volt customer as part of their use of the Services, we will refer your request to that customer as described in Section 6.

9. Communications Preferences

You can manage your receipt of marketing communications by clicking the "unsubscribe" link at the bottom of our marketing emails, or by sending your preferences to help@textvolt.com. We only send marketing communications to individuals who have signed up for them or otherwise agreed to receive them. You cannot opt out of transactional communications related to your account or the Services, such as billing notices and security alerts, while you maintain an account with us.

10. Public Forums

If Volt provides bulletin boards, blogs, or community forums on the Sites, any information you choose to submit there may be read, collected, and used by others. We are not responsible for personally identifiable information you choose to post in public forums.

11. Links to Third-Party Websites

The Sites may contain links to other websites. We are not responsible for the information practices or content of other websites, and we encourage you to review their privacy policies.

12. International Visitors

Volt is based in the United States, and the information we collect is processed and stored in the United States. If you access the Sites or Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page with a new effective date, and we will provide notice of material changes through the Sites at least thirty (30) days before the change takes effect.
